1. General

Welcome to our website www.thelmalouise.be

1.1  These general terms and conditions (hereinafter the “General Terms”) apply to the contractual relations between the Belgian company SOM-BELLE BV having its registered office at Krijgsbaan 39, 2640 Mortsel registered with the Belgian trade register under the number BE0891 945 385, hereinafter called “Thelma & Louise Antwerp” and/or “us”, and the “Customer” and/or “you” on the website: www.thelmalouise.be, hereinafter called “thelmalouise.be”.

1.2  The purpose of the General Terms is to define the terms and conditions for the online sale of products marketed by Thelma & Louise Antwerp on thelmalouise.be (the “Products”).

1.3  These General Terms shall apply to all orders of Products (the “Order”)

1.4  Placing an Order with Thelma & Louise Antwerp implies the full acceptance of these General Terms excluding any other document. 

1.5  Online acceptance of these General Terms is confirmed by a mandatory box-checking process during the finalization of Orders on thelmalouise.be.

1.6  The General Terms remain applicable throughout the Order process on thelmalouise.be. The applicable terms are those in force on the date on which the Order is placed. 

Please note that these terms and conditions are periodically amended. Therefore, we recommend you read them carefully every time you visit this website. Thelma & Louise Antwerp accepts no other conditions, unless agreed upon in writing.

 

2. Privacy statement

Our privacy statement contains information on how Thelma & Louise Antwerp will use your details. By accepting these general terms and conditions you also commit to our privacy statement.

 

3. Orders

3.1  You may place an Order on thelmalouise.be for any Product that is available and depending on the availability of these Products in our stock.  

3.2  When you place an Order on thelmalouise.be, you enter into a binding sale between you, as a consumer, and us as a seller. The Order will only be effective following full payment of the price (incl. VAT) and acceptance of the General Terms in force at the time of the Order by checking the box described in (1). 

3.3  By placing an Order, you expressly agree with the General Terms, including all declarations and sections such as the privacy statement and returns policy. 

Please note: thelmalouise.be only sells Products to private individuals on its B2C platform. If you plan to buy Products that are not meant for personal use, but for resale, for example, or if you plan to buy them on behalf of your company, you can only do so by contacting Us and working through our B2B channel. 

In the unfortunate event that a Product you have ordered is out of stock, our customer service team will inform you immediately and offer you an alternative solution (e.g. shipping at a later date, a replacement product or a refund). Needless to say, any solution offered will be free of charge.

Thelma & Louise Antwerp reserves the right to amend or cancel an Order if the prices or discounts displayed on the website are incorrect or if they were incorrectly processed in the payment stage.

 

4. Product information

4.1  Thelma & Louise Antwerp is committed to ensuring that the Products comply with the descriptions provided on thelmalouise.be, the quality standards you can reasonably expect and the legal provisions existing on the date of the Order. 

4.2  The prices stated apply to each individual item and include 21% VAT. Prices do not include postage costs. The prices stated are valid on the date on which they were posted on the website and on the date on which an Order is placed. These prices may be subject to change during the course of the season. If items are priced down or any discount applies to the items after an Order is placed, the Customer cannot claim any repayment of the relevant price difference or terminate the relevant sales transaction.

4.3  Thelmalouise.be is not responsible for any form of customs duty or other taxes that may apply after the Products are dispatched.

 

5. Payments

5.1  Once you have placed your Order, you are referred to a secure payment page on our website, where you are asked to pay for your Order. 

5.2  We accept Visa, MasterCard, Maestro, debit and credit cards, iDeal and Bancontact.

5.3  An Order confirmation will appear on your screen and you will receive an e-mail confirmation once your payment has been made. By paying for your Order, you give MultiSafepay (Kraanspoor 39, 1033 SC Amsterdam, Postbus 37159, 1030 AD Amsterdam, Nederland) permission to store your financial details securely, so that you do not need to re-enter them for future orders on thelmalouise.be.

5.4  If you are granted a refund, we will credit the card or bank account used for the payment. We cannot be held liable for fluctuations between the currency used for the first payment and the currency of your credit card or bank account once the amount paid is refunded.

 

6. Shipping and delivery

6.1  We aim to ship Orders within one to two working days following receipt of your payment. It normally takes two to three working days for your order to be delivered to the address provided (excluding weekends and public holidays in Belgium and the destination country). 

Please note that Saturdays, Sundays and official public holidays are not considered working days. Orders placed on Friday afternoon or during the weekend are processed on Monday.

6.3  In the event that our courier service loses your parcel, we will offer you a voucher covering the full amount of your order, allowing you to re-order the items in question. Please note that we cannot offer you a refund for lost orders.

7. Returns and refunds 

7.1  You have the right to return the items you have purchased within 14 calendar days. This period starts on the day you receive your order. After this period, return requests will no longer be accepted. 

7.2  Do not forget to include the returns form. It enables us to recover your order number and details.

7.3  Thelma & Louise Antwerp will only accept to refund Products provided that they are returned intact with their original packaging and accessories and in particular provided that the following conditions are met: the Product must not be worn, washed and/or damaged. The labels must also still be attached to the Products. 

7.4  For more information on the Returns process, please refer to the page “Shipping & Returns”. 

7.5  The refund will be operated using the same means of payment as those initially used by the Customer for the payment of his Order and this within 14 days following receipt of the returned Product. 

7.6  Thelma & Louise Antwerp does not permit exchanges on thelmalouise.be

 

8. Cancellation of an order

In accordance with the Consumer Rights Act and Section 9 of the Directive 2011/83 of the European Parliament and of the Council on consumer rights, you, as a consumer, have a period of 14 days from the day of the receipt of the Products ordered, to cancel your Order, without giving any reason.

A written request for cancellation must imperatively be sent before the expiry of the cancellation period to the following email address stock@thelmalouise.be

If the Product ordered has already been delivered at the time the Customer decides to cancel, the Product must be returned in its packaging to the below mentioned address within 14 days of the day on which you made your written request to cancel the Order. 

If the aforementioned conditions are fulfilled and subject to compliance with the return conditions stipulated in (7), Thelma & Louise Antwerp will proceed with the refund or exchange of the Product at the Customer’s choice, according to the conditions stipulated 

All complaints or disputes must be reported by e-mail to stock@thelmalouise.be immediately on delivery of Products and no later than 14 days after delivery. 

In the event that a complaint is found to be valid, thelmalouise.be’s liability will be limited to exchanging the items, provided that they are in stock. If the items concerned in the valid complaint cannot be exchanged, they will be refunded including postage and packaging costs. All liability attaching to thelmalouise.be is limited to the sum actually paid for the non-conforming order.

9. Intellectual property

9.1  The use of thelmalouise.be is reserved for strictly personal use unless expressly and specifically agreed otherwise by Thelma & Louise Antwerp. 

9.2  Thelma & Louise Antwerp retains full and exclusive property of the various data transmitted under these General Terms under the various laws relating to the protection of copyright and neighboring rights, trademarks and patents law and in particular the Act on the legal protection of databases as well as all trademarks, texts, comments, works, illustrations and images, whether visual or sounds, reproduced on thelmalouise.be. 

9.3  Any full of partial reproduction of Thelma & Louise Antwerp’s catalogue and/or thelmalouise.be is only authorized for the exclusive purpose of information for private and personal use. Any reproduction or use of copies made for other purposes is strictly prohibited. 

 

10. Copy of contract

Thelma & Louise Antwerp stores an electronic copy of your order in accordance with the legal requirements. You can print the Order confirmation that appears on your screen as soon as you have placed an Order and the payment has been processed. You will also receive an Order confirmation by e-mail. You can find an overview of your past orders in your account.

 

11. Applicable legislation and competent courts

This agreement between you and Thelma & Louise Antwerp is governed exclusively by Belgian law. The courts of Antwerp (Belgium) and, if you are an inhabitant of the European Union, the courts in your place of residence, have sole jurisdiction. If any provision in these conditions becomes invalid, this shall not affect the validity of the remaining provisions (valid and enforceable). Possibility of dispute resolution online:  The European Commission offers consumers the opportunity to resolve disputes using one of its online platforms.
